1. Acceptance of Terms

By downloading, installing, or using the Brekele Wallpaper application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Brekele ("we", "us", or "our") regarding your use of the Brekele Wallpaper application.

2. Description of Service

Brekele Wallpaper is an Android application that provides users with:

  • Static wallpapers for device customization
  • Live wallpapers with animated effects
  • Video wallpaper functionality
  • 3D cube wallpaper features
  • Favorite management system
  • Coin-based reward system for premium content

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on Android devices that you own or control.

You may not:

  • Copy, modify, or distribute the App
  • Sell, rent, lease, assign, distribute, transmit, or otherwise exploit the App
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Remove any proprietary notices or labels from the App
  • Use the App for any illegal or unauthorized purpose

4. User Responsibilities

You agree to use the App in accordance with all applicable laws and regulations. You are responsible for:

  • Maintaining the confidentiality of your device
  • All activities that occur through your device
  • Ensuring your device meets the minimum requirements for the App
  • Obtaining necessary permissions for any content you upload or share

5. In-App Purchases and Virtual Currency

The App includes a coin-based virtual currency system and offers in-app purchases:

  • Coins: Virtual currency that can be earned by watching advertisements or purchased with real money
  • Premium Content: Certain wallpapers or features may require coins to unlock
  • No Cash Value: Coins have no cash value and cannot be exchanged for real money
  • Non-Transferable: Coins are tied to your device/account and cannot be transferred
  • Refunds: All purchases are subject to Google Play Store's refund policy

We reserve the right to modify the value of coins, discontinue the coin system, or change pricing at any time.

6. Advertisements

The App may display advertisements provided by third-party ad networks, including but not limited to Google AdMob:

  • Ads may be displayed during normal App usage
  • Users may watch voluntary video ads to earn coins
  • Third-party ad networks may collect data in accordance with their own privacy policies
  • We are not responsible for the content or practices of third-party advertisers

7. User Content

The App allows you to use your own images and videos as wallpapers:

  • You retain all rights to your content
  • You are responsible for ensuring you have the right to use any content you upload
  • You may not use content that violates any laws or third-party rights
  • We do not claim ownership of your content

8. Intellectual Property

The App and its original content, features, and functionality are owned by Brekele and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Brekele Wallpaper name, logo, and all related branding are trademarks of Brekele. All rights reserved.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of any content

We do not warrant that the App will meet your requirements or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREKELE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Personal injury or property damage
  • Any damages resulting from your use or inability to use the App
  • Any unauthorized access to or alteration of your data

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App, or $10 USD if you obtained the App for free.

11. Indemnification

You agree to indemnify, defend, and hold harmless Brekele and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your use of any content you upload or share

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Suspected fraudulent or illegal activity
  • Technical or security issues

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Indonesia.

15. Age Restrictions

The App is intended for users aged 13 and older. If you are under 13, you may not use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

16. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by Brekele. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

Third-party services include:

  • Google Play Store (for app distribution and in-app purchases)
  • Google AdMob (for advertising services)
  • Google Play Billing (for payment processing)
